Privacy

Your Research processes personal data. If you participate in a study via the app, we usually process your personal data on behalf of the research institution. In some cases, Your Research processes the personal data on your behalf, for example when you request information via our website or register for a study.

Who is the processor of my personal data?

That’s Your Research. We are located at Zeeweg 28, 1271VX in Huizen. Your Research also has a Data Protection Officer, who can be reached via privacy@yourresearch.com or call +31(0)85 0043 969.

What is the purpose of the processing of my personal data by Your Research?

When you share your contact details with us, we use your information to inform the studyteam team that you are interested in participating into the study or that you already participate in the study and want to use the app to fulfill task and/or read information.

When you use our app, we need your data to enable the use of the app, to determine whether you meet the age limit set out in the GDPR and to enable research institutions to conduct research.

Your Research will also inform you without obligation about possible relevant studies for which participants are being sought.

We only use your personal data if you have given us permission to do so.

What personal data does Your Research need from me?

That differs. If you only want to contact Your Research, we only need your name and e-mail address.

If you would like to participate in a survey, we will also ask you for the personal data necessary to participate in the survey. Together with the research institutions, Your Research strives for data minimization: we will only ask you for the personal data that is strictly necessary for the research, you can optionally provide us with the other personal data.

Which personal data is required differs per study and you can view it before we ask you for permission. Examples of personal data we may ask for are your telephone number, address, time zone and IP address.

We may also need special personal data from you, among other things to determine whether you belong to the target group of this research. You can think of data about your health. We handle this personal data with extra care and only process this personal data with your explicit permission.

For some studies, Your Research also needs your location information (GPS). In that case, Your Research will ask you for permission in advance and you can also withdraw your permission at any time.

Does Your Research provide my personal data to third parties or are they stored outside the European Union?

Your Research may provide your personal data to third parties. Your Research only does this if this is necessary, for example for the hosting of the website and the technical support of the Your Research app.

When you participate in a study, Your Research will in any case share your personal data with the research institution that conducts the study in which you participate. The third parties we engage may vary per study, please contact our Data Protection Officer to find out which third parties we have engaged for the study you are or will be participating in.

Your Research always ensures that your personal data is stored within the European Union.

What retention period does Your Research use for my personal data?

We do not store your personal data for longer than is legally permitted and necessary. You can always have your personal data removed upon request.

When you use our app, your personal data will be stored as long as you actively use the app. If you are inactive for twelve months, we will ask you if you want to use the app for even longer. If that is not the case, we will delete your personal data after another three months.

If you wish to discontinue using our software and submit a request for the removal of your personal data through our app, Your Research will fulfill this request within 90 days. Upon making the request, you will promptly receive a confirmation from the study stating that your account will be deleted after 90 days (account deactivation will occur). After 30 days, you will receive a reminder that your account will be deleted after 60 days (please log in during this period to reactivate it if desired). Once 90 days have elapsed, your account will be permanently deleted, and you will receive a confirmation (complete cessation of account personal data).

What rights do I have with regard to my personal data?

You have the following rights: the right to inspect the personal data that we process about you, the right to correction, addition and, where necessary, the removal of your personal data. You may also have personal data transferred to a third party.

When you submit a request for access to us, we will respond to the request within one month or let you know that we need more time. In all cases, we will respond to your request for access within three months. A request for access is free, unless your request is unfounded or unreasonable. We will then charge a reasonable fee or refuse your request for access.

How is my personal data protected?

Your Research has taken appropriate technical and organizational security measures to protect your personal data, including certification in accordance with ISO 27001 and NEN 7510.

User rights

These terms of use specify the conditions under which you may use the Your Research software. These terms of use apply to the use of Your Research Portal and App, for which we use the generic term “app” in these terms and conditions.

Right of use

Your Research grants you the right to use the app in accordance with these terms of use and applicable laws and regulations. It is only allowed to use the app personally or on behalf of housemates. You may also use the app as a researcher to enter data from participants in a study, provided that the relevant participant has given permission for this.

More specifically, it is not allowed to make changes in the app or the source code of the app in any way or to make the app available to third parties in any form. Of course it is allowed to make a backup copy of the app for backup purposes.

Intellectual property rights

All rights to the app are and remain the property of Your Research, you are granted a limited right of use based on these terms of use and may only use the app to participate in the studies for which you have signed up. This app also contains open source code from third parties to which separate license terms apply in addition to these terms of use. We will inform you about these license conditions on request.

Support & Updates

Responsibility for the use and installation of the app rests with you. Your Research will support you as much as possible through its website, but does not guarantee that all problems will be solved.

Updates for the app are regularly released by Your Research. It is your responsibility to download it from the app store and install it properly, Your Research cannot be held responsible for this.

Installing updates requires your permission. If changes are also made to these terms of use with an update, you agree to these changes by installing the update.

Liability & Warranties

The use of the app is free. Your Research makes every effort to keep the app available as much as possible and to correct errors, but therefore does not give any guarantee and can in no way be held liable for any form of damage, with the exception of damage that arises as a result of intent or recklessness.

Term of terms of use

These terms of use come into effect from the moment you use the app and in any case remain in effect until you stop using the app and your data has been deleted.

This agreement can be terminated at any time by either you or Your Research. After termination of this agreement, the app (including any backup copies) must be deleted.

Other

Dutch law applies to these terms of use. In the event of a dispute, we will first look for a solution together. If that is not possible, the dispute will be submitted to the competent court according to the law.

Your Research may transfer this agreement with you to a third party in the context of a business acquisition. In that case, Your Research will inform you in good time.

Any nullity of provisions of these conditions does not affect the validity of the rest of the conditions. We will then consult and determine the new provisions that do justice to the intention of the original conditions as much as possible.

Privacy

Your Research verwerkt persoonlijke gegevens. Als je deelneemt aan een studie via de app, verwerken we meestal jouw persoonlijke gegevens namens de onderzoeksinstelling. In sommige gevallen verwerkt Your Research de persoonlijke gegevens namens jou, bijvoorbeeld wanneer je informatie aanvraagt via onze website of je aanmeldt voor een studie.

Wie is de verwerker van mijn persoonlijke gegevens?

Wat is het doel van de verwerking van mijn persoonlijke gegevens door Your Research?

Wanneer je jouw contactgegevens met ons deelt, gebruiken we jouw informatie om het studieteam te informeren dat je geïnteresseerd bent in deelname aan de studie of dat je al deelneemt aan de studie en de app wilt gebruiken om taken uit te voeren en/of informatie te lezen.

Wanneer je onze app gebruikt, hebben we jouw gegevens nodig om het gebruik van de app mogelijk te maken, om te bepalen of je voldoet aan de leeftijdsgrens zoals vastgelegd in de AVG, en om onderzoeksinstellingen in staat te stellen onderzoek uit te voeren.

Your Research zal je ook vrijblijvend informeren over mogelijke relevante studies waarvoor deelnemers worden gezocht.

We gebruiken jouw persoonlijke gegevens alleen als je ons daarvoor toestemming hebt gegeven.

Welke persoonlijke gegevens heeft Your Research van mij nodig?

Dat verschilt. Als je alleen contact wilt opnemen met Your Research, hebben we alleen jouw naam en e-mailadres nodig.

Als je wilt deelnemen aan een onderzoek, vragen we je ook om de persoonlijke gegevens die nodig zijn om deel te nemen aan het onderzoek. Samen met de onderzoeksinstellingen streeft Your Research naar gegevensminimalisatie: we vragen je alleen om de persoonlijke gegevens die strikt noodzakelijk zijn voor het onderzoek; je kunt ons optioneel de overige persoonlijke gegevens verstrekken.

Welke persoonlijke gegevens nodig zijn, verschilt per studie en je kunt dit bekijken voordat we je om toestemming vragen. Voorbeelden van persoonlijke gegevens die we kunnen vragen, zijn je telefoonnummer, adres, tijdzone en IP-adres.

We hebben mogelijk ook bijzondere persoonlijke gegevens van je nodig, onder andere om te bepalen of je tot de doelgroep van dit onderzoek behoort. Je kunt denken aan gegevens over jouw gezondheid. We gaan zorgvuldig om met deze persoonlijke gegevens en verwerken deze alleen met jouw uitdrukkelijke toestemming.

Voor sommige onderzoeken heeft Your Research ook jouw locatiegegevens (GPS) nodig. In dat geval vraagt Your Research je vooraf om toestemming en je kunt deze toestemming op elk moment intrekken.

Verstrekt Your Research mijn persoonlijke gegevens aan derden of worden ze opgeslagen buiten de Europese Unie?

Your Research kan jouw persoonlijke gegevens aan derden verstrekken. Your Research doet dit alleen als dit noodzakelijk is, bijvoorbeeld voor de hosting van de website en de technische ondersteuning van de Your Research App.

Wanneer je deelneemt aan een studie, zal Your Research in ieder geval jouw persoonlijke gegevens delen met de onderzoeksinstelling die het onderzoek uitvoert waarin je deelneemt. De derden die we inschakelen kunnen per studie verschillen, neem contact op met onze Functionaris Gegevensbescherming om te ontdekken welke derden we hebben ingeschakeld voor de studie waaraan je deelneemt of gaat deelnemen.

Your Research zorgt er altijd voor dat jouw persoonlijke gegevens binnen de Europese Unie worden opgeslagen.

Wat is de bewaartermijn die Jouw Onderzoek hanteert voor mijn persoonlijke gegevens?

We bewaren jouw persoonlijke gegevens niet langer dan wettelijk toegestaan en noodzakelijk is. Je kunt altijd op verzoek jouw persoonlijke gegevens laten verwijderen.

Wanneer je onze app gebruikt, worden jouw persoonlijke gegevens opgeslagen zolang je de app actief gebruikt. Als je twaalf maanden inactief bent, vragen we je of je de app nog langer wilt gebruiken. Zo niet, dan verwijderen we jouw persoonlijke gegevens na nog eens drie maanden.

Als je wilt stoppen met het gebruik van onze software en een verzoek indient voor het verwijderen van jouw persoonlijke gegevens via onze app, zal Your Research dit verzoek binnen 90 dagen inwilligen. Na het indienen van het verzoek, ontvang je direct een bevestiging van de studie dat jouw account na 90 dagen wordt verwijderd (accountdeactivatie zal plaatsvinden). Na 30 dagen ontvang je een herinnering dat jouw account na 60 dagen wordt verwijderd (log in gedurende deze periode om het eventueel te reactiveren). Na 90 dagen wordt jouw account definitief verwijderd en ontvang je een bevestiging (volledige stopzetting van account persoonlijke gegevens).

Welke rechten heb ik met betrekking tot mijn persoonlijke gegevens?

Je hebt de volgende rechten: het recht om de persoonlijke gegevens die wij over jou verwerken in te zien, het recht op correctie, aanvulling en, indien nodig, verwijdering van jouw persoonlijke gegevens. Je kunt ook persoonlijke gegevens laten overdragen aan een derde partij.

Wanneer je een verzoek tot inzage aan ons indient, reageren we op het verzoek binnen een maand of laten we je weten dat we meer tijd nodig hebben. In alle gevallen zullen we binnen drie maanden op jouw verzoek tot inzage reageren. Een verzoek tot inzage is gratis, tenzij jouw verzoek ongegrond of onredelijk is. We zullen dan een redelijke vergoeding in rekening brengen of jouw verzoek tot inzage weigeren.

Hoe worden mijn persoonlijke gegevens beschermd?

Your Research heeft passende technische en organisatorische beveiligingsmaatregelen genomen om jouw persoonlijke gegevens te beschermen, waaronder certificering in overeenstemming met ISO 27001 en NEN 7510.

Ik heb een klacht. Wat nu?

Neem dan even contact met ons op via bovenstaande contactgegevens. Wij doen er alles aan om je te helpen. Mochten we er samen niet uitkomen, dan kun je contact opnemen met de Autoriteit Persoonsgegevens.

Deze gebruiksvoorwaarden specificeren de condities waaronder je de Your Research-software mag gebruiken. Deze gebruiksvoorwaarden zijn van toepassing op het gebruik van Your Research Portal en App, waarvoor we de algemene term “app” gebruiken in deze voorwaarden.

Gebruikersvoorwaarden

Gebruiksrecht

Your Research verleent je het recht om de app te gebruiken in overeenstemming met deze gebruiksvoorwaarden en de toepasselijke wetten en regelgeving. Het is alleen toegestaan om de app persoonlijk te gebruiken of namens huisgenoten. Je mag de app ook gebruiken als onderzoeker om gegevens van deelnemers aan een studie in te voeren, mits de betreffende deelnemer hiervoor toestemming heeft gegeven.

Meer specifiek is het niet toegestaan om wijzigingen in de app of de broncode van de app aan te brengen of de app in welke vorm dan ook aan derden beschikbaar te stellen. Natuurlijk is het wel toegestaan om een back-upkopie van de app te maken voor back-updoeleinden.

Intellectuele eigendomsrechten

Alle rechten op de app zijn en blijven eigendom van Your Research, je krijgt een beperkt gebruiksrecht op basis van deze gebruiksvoorwaarden en mag de app alleen gebruiken om deel te nemen aan de studies waarvoor je je hebt aangemeld. Deze app bevat ook open source code van derden waarop naast deze gebruiksvoorwaarden aparte licentievoorwaarden van toepassing zijn. We informeren je hierover op verzoek.

Ondersteuning & Updates

De verantwoordelijkheid voor het gebruik en de installatie van de app ligt bij jou. Your Research zal je zo veel mogelijk ondersteunen via haar website, maar garandeert niet dat alle problemen worden opgelost.

Updates voor de app worden regelmatig uitgebracht door Your Research. Het is jouw verantwoordelijkheid om deze te downloaden uit de app store en correct te installeren, Your Research kan hiervoor niet verantwoordelijk worden gehouden.

Het installeren van updates vereist jouw toestemming. Als er ook wijzigingen worden aangebracht in deze gebruiksvoorwaarden met een update, ga je akkoord met deze wijzigingen door de update te installeren.

Aansprakelijkheid & Garanties

Het gebruik van de app is gratis. Your Research doet er alles aan om de app zo veel mogelijk beschikbaar te houden en om fouten te corrigeren, maar geeft daarom geen garantie en kan op geen enkele manier aansprakelijk worden gesteld voor enige vorm van schade, met uitzondering van schade die ontstaat als gevolg van opzet of roekeloosheid.

Duur van de gebruiksvoorwaarden

Deze gebruiksvoorwaarden worden van kracht op het moment dat je de app gebruikt en blijven in ieder geval van kracht totdat je stopt met het gebruik van de app en je gegevens zijn verwijderd.

Deze overeenkomst kan op elk moment door jou of Your Research worden beëindigd. Na beëindiging van deze overeenkomst moet de app (inclusief eventuele back-upkopieën) worden verwijderd.

Overig

Op deze gebruiksvoorwaarden is het Nederlands recht van toepassing. In geval van een geschil zullen we eerst samen naar een oplossing zoeken. Als dat niet mogelijk is, wordt het geschil voorgelegd aan de bevoegde rechter volgens de wet.

Your Research mag deze overeenkomst met jou overdragen aan een derde partij in het kader van een bedrijfsovername. In dat geval zal Your Research je tijdig informeren.

De eventuele nietigheid van bepalingen van deze voorwaarden tast de geldigheid van de rest van de voorwaarden niet aan. We zullen dan overleggen en de nieuwe bepalingen vaststellen die zoveel mogelijk recht doen aan de bedoeling van de oorspronkelijke voorwaarden.
